Praise be to Allah.
Undoubtedly from the fiqhi point of view, this action of theirs is permissible, but in my view these people have in fact come for leisure purposes, because they are not following the Sunnah as it was narrated from the Messenger of Allah (blessings and peace of Allah be upon him). The Prophet (blessings and peace of Allah be upon him) stayed in Mina both day and night. Hajj is jihad, not a leisure trip. I do not know how these people can feel that they are worshipping and turning to Allah, and that they are still performing Hajj, when they go to those apartments to be comfortable and perhaps they may have with them entertainment devices, then they go back to Mina for part of the time. I do not know how they can feel that they are doing an act of worship. Therefore the Muslims should pay attention to this issue in which many people are implicated: they take the views of the fuqaha’, pr what may be implied by their rulings, but they forget that the issue is worship. Therefore the individual should do it as the Prophet (blessings and peace of Allah be upon him) did it, because he said: “Learn from me your rituals of pilgrimage.” So we say: Stay in your tent, even if it is hot, and even if you start to sweat, and even if you experience hardship and difficulty, for it is in obedience to Allah, and it is the matter of a few days. All of pilgrimage does not take any longer than six days, the eighth, the ninth, the tenth, the eleventh, the twelfth and the thirteenth [of Dhu’l-Hijjah] for the one who delays his departure from Mina. You have come from your country, leaving behind your family and your wealth, and you have taken the risks of travelling, yet you are unable to restrain yourself for six days, or five days, or less than four days. By Allah, this distresses me very much, and it pains me greatly. If some people issue fatwas based on what is implied by the views of the fuqaha’, after that pilgrimage will turn into a leisure trip. We ask Allah to guide us and you. I think that in the case of these people whom you mentioned in your question, their pilgrimage is undoubtedly lacking, because they did not follow the Sunnah and stay in Mina by night and day.
