He has a home in Jeddah and he went back to it before doing tawaaf al-ifaadah and tawaaf al-wadaa‘, to wait until the crowds grew less. What must he do?

Question

I am living in Austria and I have a home in Jeddah. I was in Hajj and I went from Mina to Harram to do Tawaf al Wadaa and Ifada together. It was VERY busy and I thought it was unsafe so I left. I went to Jeddah and now I am going to Mecca to do the tawaaf wadaa and ifada. Do I need to Slaughter anything

Answer

Praise be to Allah.

Firstly:

Tawaaf al-ifaadah is one of the pillars or essential parts of the Hajj, and the muhrim (pilgrim in ihram) cannot fully exit ihram except by doing it. Based on that, if a person has not done tawaaf al-ifaadah then he is still in ihram, and he must do two things:

1. Refrain from intercourse until he has done tawaaf al-ifaadah, then exit ihram completely.

2. Go to Makkah and do tawaaf al-ifaadah.

This has previously been explained in fatwa no. 85667

We have also previously explained that the pilgrim may delay tawaaf al-ifaadah and do one tawaaf for both ifaadah and wadaa‘, when he is leaving Makkah. Please see Fatwa no. 36870

Secondly:

When a person has done tawaaf al-ifaadah, and completed his Hajj rituals, it is not permissible for him to leave Makkah, whether he is going to Jeddah or anywhere else, before doing tawaaf al-wadaa‘, because tawaaf al-wadaa‘ is obligatory according to the more sound of the two scholarly opinions. Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) was asked: Is it right for people who live in Jeddah to leave Mina and go straight to Jeddah, without doing tawaaf al-wadaa ‘, then to come back after a few days to do tawaaf al-wadaa‘?

He (may Allah have mercy on him) replied:

It is not permissible for the people of Jeddah or anyone else to go back to their cities before doing tawaaf al-wadaa‘, then come back to Makkah when the crowds have decreased. They should not leave Makkah until they have done tawaaf al-wadaa‘, because the Prophet (blessings and peace of Allah be upon him) said: “No one of you should leave until the last thing he has done is circumambulate the House (the Ka‘bah).” Ibn ‘Abbaas said: The people used to disperse in all directions, but the Prophet (blessings and peace of Allah be upon him) said: “No one of you should leave until the last thing he has done is circumambulate the House (the Ka‘bah)..”

End quote from Majmoo‘ Fataawa Ibn ‘Uthaymeen (23/353)

In fact if he comes back after that to do tawaaf al-wadaa‘, it will not benefit him. Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said: If he leaves Makkah heading towards Jeddah, and he reaches Jeddah, then if he does it (tawaaf al-wadaa‘, after that), it will not benefit him, because he already left and departed, so how can it benefit him after he left and departed?

End quote from Majmoo‘ Fataawa Ibn ‘Uthaymeen (23/353)

Thirdly:

If a person has not completed the rituals of Hajj and it still remains for him to do tawaaf al-ifaadah – as is the case in this question – and he wants to leave  Makkah, one of the following two scenarios must be applicable in his case:

1. He wants to go back to his city because of some need, or until the crowds decrease, then come back and complete his rituals and do tawaaf al-wadaa‘. This is not permissible, because in this case he has left Makkah before completing his rituals and before doing tawaaf al-wadaa‘.

We have previously discussed that in the answer to question no. 106551.

2. He is leaving to go somewhere other than his own city, because of some need, then he wants to come back and complete his rituals and do tawaaf al-wadaa‘ before he leaves. In this case there is nothing wrong with it, in fact, because he has not yet left Makkah and he is still travelling.

Shaykh Ibn ‘Uthaymeen (may Allah have mercy on him) said concerning a similar case:

This man is one of the people of Haa’il, and what may be understood from his question is that when he left Mina to complete the rituals, he did not do tawaaf al-ifaadah because he was delaying it in order to combine it with tawaaf al-wadaa‘, because he did sa‘i between as-Safa and al-Marwah, then he went out to Jeddah because of some need, and he came back and did tawaaf and left. We say to him: there is no blame on him for going out to Jeddah before doing tawaaf al-wadaa‘, because Jeddah is not his city, and in fact he did not leave Makkah to go to his city or his place of residence; rather he came back from Jeddah, then he did tawaaf al-wadaa‘, then he travelled to Haa’il, which is his place of work. There is nothing wrong with doing that.

Based on that, you have to offer a sacrifice, because you left Makkah to go to your city before doing tawaaf al-wadaa‘.
